Custom Web Site Design Terms and Conditions

 The following terms and conditions apply to all web site design services offered by CraftImage Designs. By ordering this service from CraftImage Designs you are agreeing to the following terms and conditions.

PROPOSAL

The Client will be given free initial consultation. CraftImage Designs will then prepare a proposal outlining the work, including price and a time frame. On proposal acceptance the Client will be forwarded a copy of CraftImage Designs' 'Terms and Conditions'.

PAYMENT SCHEDULE

Once the proposal and 'Terms and Conditions' has been agreed upon CraftImage Designs requires 50% of the total amount due before starting work on a custom web site design. The remaining balance must be paid upon completion of the project or 90 days after beginning the project, whichever comes first. CraftImage Designs and the Client must work together to complete the web design project in a timely manner. We agree to work expeditiously to complete the web design project in as little as 30 days and no later than 90 days if the Client has submitted all necessary materials.

DESIGN AND AMENDMENTS

CraftImage Designs strives to provide excellent customer service. To that end, CraftImage Designs encourages input from the Client during the design process. The Client will be given two (2) design choices, after the Client chooses their preferred design the Client is allowed two revisions to chosen design. CraftImage Designs will be given final approval of a design by the Client before developing the web site. Changes to the design after approval has been given and development has begun are not included in the initial agreement and are therefore billed at an hourly rate.

CONTENT

All material, both text and images, supplied by the Client and used in the construction of the Client's web site, will remain the Client's property. All such material will be assumed to be the property of the Client and free to use without fear of breach of copyright laws. The Client will not provide material to CraftImage Designs for use in a web site design that violates such laws. CraftImage Designs shall not be held liable for the accuracy of any information supplied by the Client and contained in Client's website.

FINAL APPROVAL

CraftImage Designs will initially place the Client's website on CraftImage Designs' demonstration server during development in order that the Client may view and comment upon the website's progress. When both CraftImage Designs and the Client agree that the website meets the criteria agreed to in the contract, CraftImage Designs will invoice the Client for the balance due for the commission. On receipt of payment, CraftImage Designs will publish the website on the Client's host server.

SCHEDULE

CraftImage Designs and Client shall agree to a schedule of deadlines before commencing work on a project. Meeting project deadlines will be dependent on the provision of content/information for the project by the Client. Failure by Client to provide content/information promptly will result in the project deadline being re-scheduled.

PROJECT DELIVERY

The web site design project will be published to the Client's hosting service upon receipt of the second payment. The Client understands that CraftImage Designs does not provide any hosting services in connection with this web design project. The Client agrees to select a hosting service which allows CraftImage Designs full access to the Client's account. The Client will be solely responsible for all hosting service charges.

Publishing: If the hosting service has FrontPage 98 /2000/2004 extensions installed, CraftImage Designs will use FrontPage 98/2000/2004 to publish to the site. If the hosting service does not have FrontPage 98 extensions installed, CraftImage Designs will use FTP to publish to the site.

DATA BACKUP

Whilst CraftImage Designs shall use its reasonable endeavor to ensure that backup copies of the Web Site and all Client data contained in the Web Site are made, the Client shall be solely responsible for the backup of such data and CraftImage Designs shall not be liable for any damages, loss, costs or other expenses arising out of or in connection with any loss of data by the Client which are due to the failure of the Client or CraftImage Designs to back up such data after site completion.

COSTING AND BILLING

The cost estimates agreed upon by CraftImage Designs and Client are based on the requirements specified in the accepted proposal. Any change in the requirements will impact the cost of the project. On the agreed completion date or milestone the Client will be invoiced for the agreed fees as detailed in the Proposal. CraftImage Designs sends all invoices on email only and all invoices are due on presentation.

PRIVACY

CraftImage Designs will not give out Client's confidential information, including but not limited to names, addresses and trade secrets. CraftImage Designs agrees to take reasonable precautions to prevent unauthorized disclosure of confidential information.

CANCELLATION

A valid cancellation will take place if the same is communicated in writing and is mutually agreed upon or full and final payment has been received by CraftImage Designs with respect to project. CraftImage Designs reserves the right to change or modify any of the terms and conditions contained in this Agreement at any time and to determine whether and when any such changes apply to both existing or future customers. These terms and conditions apply to custom web design. Other projects or services may be bound by separate terms and conditions.
